We've created a simple template agreement for you to download and use when engaging a tradesperson to undertake work in your home.
This agreement ("Agreement") is made and entered into on the date of acceptance by the Contractor, by and between the Homeowner, [Name], with a mailing address of [Address] (hereinafter referred to as "Homeowner"), and the Contractor, [Name], with a mailing address of [Address] (hereinafter referred to as "Contractor").
Purpose: The purpose of this Agreement is to engage the Contractor to perform maintenance work on the Homeowner's property located at [Address] (hereinafter referred to as "Property"). The scope of work is outlined in Exhibit A attached to this Agreement.
Term: The term of this Agreement shall commence on [Start Date] and shall end on [End Date].
Payment: The total cost for the work to be performed under this Agreement is [Total Cost]. The Homeowner shall pay the Contractor a deposit of [Deposit Amount] upon execution of this Agreement. The Homeowner shall make progress payments to the Contractor as follows: [Payment Schedule]. The final payment of [Final Payment Amount] shall be due upon completion of the work and acceptance by the Homeowner. The Contractor may request a retention of [Retention Amount] until the work is completed and accepted by the Homeowner.
Termination: This Agreement may be terminated by either party upon written notice if the other party breaches any material term or condition of this Agreement. Upon termination, the Contractor shall immediately stop all work and remove all equipment and materials from the Property.
Entire Agreement: This Agreement constitutes the entire agreement between the parties and supersedes all prior and contemporaneous agreements, understandings, and negotiations, whether oral or written. This Agreement may not be amended or modified except in writing signed by both parties.
